By visiting and / or using the Website or
using the Services (as defined hereinbelow) in any capacity, you agree to be
bound by the terms of the present Privacy Policy (the “Policy”), and consent to
our treatment and use of your Personal Information as described in this Policy.
If you are acting on behalf of a company or other organization, you acknowledge
and agree that you have the capacity to accept being bound by the Policy on their
behalf.

 

The Website is owned and operated by Border Bee Customs
Brokers
Inc. (“Border Bee”, or “we”, “our” or “us”), a duly
incorporated company in Montreal, Quebec, Canada.  Where the present Policy refers to Border Bee,
it may refer to Border Bee Inc. and / or its officers, directors, employees,
agents or representatives, depending on the context.

 

In this Policy, a Website visitor or user may
be referred to as “you”. Where you (or you acting on behalf of a company
or other organization) have registered through the Website (or other means) to
use our Customs Brokerage Services and related services (the “Services”),
you may be also be referred to as a “Client” in this Policy.

              

Border Bee reserves the right, at any time and without prior notice, to
modify or replace any of the Policy. Any
changes to the Policy can be found at this URL
. It is your
responsibility to check the Policy periodically for changes. Your use of the Website
and / or the Services following the posting of any changes to the Policy
constitutes acceptance of those changes
. If there are
any significant changes to the Policy that materially affect the way we treat
your information, Clients will be notified via email.

 

The Policy should be read in conjunction with
the Terms of Use, as both these documents govern your use of the Website
and / Services. In addition, if you sign up to use the Services, you will be
subject to a separate Services Agreement, as defined more fully in the Terms of

General Statement of Privacy and Protection of Personal Information

Border Bee takes your privacy and security of
Personal Information very seriously. We have provided a secure environment and this
strict Policy that describes the limited ways the information is used and the
limited access to such information.

 

What Does This Privacy Policy Cover?

This Policy covers the treatment of personally
identifiable information (“Personal Information”) and other information gathered
by Border Bee when you are using or accessing the Website or using the Services.
Personal Information includes any information that may identify a specific
individual or organization. This Policy also covers Border Bee’s treatment of
any Personal Information that Border Bee may share with its business partners or
other third parties under very limited circumstances. Personal Information also
includes Personal Information about you that we receive from third parties, for
example transport or shipping companies that send us information about your
shipment so that we may perform the Services. This Personal Information
received from third parties is only as used as described in this Policy like
any Personal Information received directly from you.

 

This Policy does not apply to the general practices
and treatment of information (whether personal or not) by third parties that Border
Bee does not own or control, including but not limited to any third party
websites or services that you elect to access through the Website or via a link
from the Website (“Third Party Website”), or to individuals that Border
Bee does not manage or employ. While we attempt to facilitate access or link only
to those Third Party Websites that share our respect for your privacy, we
cannot take responsibility for the content or privacy policies of those Third
Party Websites. We encourage you to carefully review the privacy policies of
any Third Party Website you access.

 

Finally, this Policy does not cover any
Personal Information you send to Border Bee via any non-secured mode of
communications such as email, instant messenger or Twitter, as communications
via these methods may be subject to interception, loss, or alteration. While we
welcome your comments and suggestions sent to us in this manner, we encourage
you to carefully examine what Personal Information you send to Border Bee via
these methods.

 

No Collection of Personal Information as a Matter of Course

Border Bee does not, as a matter of course, gather any of your Personal Information
while you are using the Website or Services, unless you are asked to provide
such information, for example by signing up for an Account. Personal
Information is only gathered with your informed consent. Where you have
provided Personal Information, it will only be used for the stated purpose, as detailed
more specifically in the next section.

 

Personal Information Collected and Its Uses

The following is an exhaustive list of Personal Information collected
from you when you use the Website or Services and what we use it for. You
acknowledge that you are submitting this Personal Information with your
informed consent.

and enter the following Personal Information for a personal Account: first and
last names, full mailing address, phone number, email, and signature. For a company
(or other organization) Account, you will be required to enter the following
Personal Information: legal business name, business number, full business
address, as well as first and last name, phone number, email address and
signature for a business contact. In this Policy, all this shall be referred to
as “Account Information”. Account
Information is used to verify your credentials to have an Account, to
communicate with you information about your Account, and to perform the
Services for you and on your behalf.

order to pay any fees owed to Border Bee or any disbursements owed to third
parties incurred during the use of the Services: credit card number, credit
card expiry date, security (CVV) number, and billing address if different from
your address in the Account Information. In this Policy, this shall be referred
to as “Billing Information”. Billing
Information is only used to process the credit card transactions for payment of
your fees and third party disbursements including applicable taxes. By
submitting your Billing Information, you authorize us to charge your credit
card in this manner and as contemplated in your Services Agreement. For more
details on the treatment of your Billing Information, please see the “Payments”
section further below in this Policy.

 

<![if !supportLists]>v   <![endif]>Guaranteed Quote.  If you wish to receive a
Guaranteed Quote from us, you must submit the following Personal Information:
name, email address, and phone number. Personal Information for a Guaranteed
Quote (“Quote Information”) may also
include any Personal Information on an invoice for goods that you uploaded, or
any NAFTA certificate you upload (as applicable). There is additional
information required, but it is not Personal Information. We use this Quote Information
in order to provide you a Guaranteed Quote, and to communicate with you about
the Guaranteed Quote.

 

<![if !supportLists]>v   <![endif]>“Importer Information”. If you would like us to assist you in getting an importer business
number from the Canadian federal government, you must submit the following
Personal Information: business name, business address, mailing address if
different, first and last name of applicant, title of applicant, Social
Insurance Number of applicant, email address, phone number, and signature. Additionally,
if you are a non-Canadian company you will be required to provide a business
verification document, and any information included on this document shall also
be Importer Information. There is additional information required, but it is
not Personal Information. The Importer Information will be used to submit to
the federal authorities in order to secure you an importer business number.

 

For further clarity Account, Billing, Quote and Importer Information are
all to be considered Personal Information for the purposes of this Policy.

 

Security and Encryption of Information

Border Bee uses only industry
best practices (physical, electronic and procedural) in keeping
any data collected (including Personal
Information) secure. In addition, Border Bee uses third party vendors and
hosting partners to provide the necessary hardware, software, networking,
storage, and related technology required to run the Website and the Services,
and these third parties have been selected for their high standards of security,
both electronic and physical. For example, Border Bee uses
bluehost, a recognized
leader in secure data, for hosting of the Website.

Personal Information Transfer to
Additional Third Parties and Third Party Providers

Border Bee makes use of certain third party
providers in order to operate the Website and perform the Services, and your
Personal Information is transferred to them as per this section of the Policy.
When you enter Personal Information on the Website as part of an Application
for an Account or for any other purpose, this Personal Information is captured
and stored by
Formstack. Border Bee uses CanData software in order to communicate
electronically with the
Canada Border
Services Agency
(“CBSA”). Your
Personal Data is stored with CanData; and the CBSA has access to your Personal
Information, and may store it as required for CBSA functions.

 

These third parties are all under legal
obligations (whether contractual and / or by force of law) to only use the
Personal Information shared with them to perform the functions required on our
behalf in order to operate the Website and / or perform the Services.

 

You acknowledge that our third party providers
and hosting partners
may be located in jurisdictions or countries where
the privacy laws may not be as protective as those in your home province,
state, country or other governmental jurisdiction.

 

Payments

Border Bee uses the third party Payfirma for processing of credit card payments of the
fees and disbursements (to Border Bee and third parties) incurred during your
use of the Services. No Billing Information is ever stored on servers
controlled by Border Bee. Payfirma has our permission to store, on behalf of Border
Bee, the data pertaining to the executed transactions by Clients (including all
Billing Information) for the purposes of ensuring a secure method of payment
and proof of purchase archive, allowing for repeat credit card charges, allowing
for the protection of Clients, and for follow-up as needed. This data may also be
used for validation and registration purposes of a Client, and to trace any
fraudulent activities if necessary. Payfirma is under contractual obligation to only use the Billing Information shared
with them to perform the functions as described in this paragraph.

 

In addition to credit card payments processed
by Payfirma, you may also pay using Interac Online. All our Interac Online
payments are processed using the third part
Beanstream. Please note that any Billing Information or
additional information required to pay via this method is sent directly from
you to Beanstream.

 

Limited Gathering of Information for Statistical, Analytical and
Security Purposes

Border Bee automatically collects certain information using a
third-party analytics program,
Google Analytics, to help us understand how our users use the
Website, but none of this information identifies you personally. For example,
each time you visit the Website, we automatically collect your IP address,
browser and computer type, access times, the web page from which you came, and
the web page(s) you access (as applicable). We use information collected in
this manner only to better understand your needs and the needs of the Website
users in the aggregate. Border Bee also makes use of information gathered for
statistical purposes to keep track of the number of visits to the Website and the
specific pages on the Website with a view to introducing improvements.

 

Your IP address
and other relevant information may be used in order to trace any fraudulent or
criminal activity, or any activity in violation of the Terms of Use.

 

Non-disclosure of Personal Information to Third Parties

Except as provided in the next paragraph and the sections in this Policy
regarding Security and Encryption of
Information, Personal Information Transfer to Additional Third Parties and
Third Party Providers,
and Payments, Border Bee does not divulge any Personal
Information gathered via the Website or Services to third parties. Moreover, Border
Bee does not sell, rent, trade or license any Personal Information regarding
its users to third parties. Only the employees, representatives,
subcontractors, officers, agents, or assigns of Border Bee are responsible for
the management and development of the Website and Services, and only these
individuals have access to the information collected there. These employees,
representatives, subcontractors, officers, agents or assigns all have been
instructed to comply with the Policy.

 

Notwithstanding anything in the Policy to the contrary, we may share any
information we have collected about you or that you have submitted (whether
Personal Information or not): (1) in response to subpoenas, court orders, or
legal process, or to establish, protect, or exercise our legal rights or defend
against legal claims or demands; (2) if we believe it is necessary in order to
investigate, prevent, or take action regarding illegal activities, fraud, or
situations involving potential threats to the safety of any person, or any
violation of the Terms of Use or Services Agreement (as applicable); (3) if we
believe it is necessary to investigate, prevent, or take action regarding
situations that involve abuse of the Website infrastructure or the Internet in
general (such as voluminous spamming, denial of service attacks, or attempts to
compromise the security of the Website infrastructure or the Website generally);
(4) to a parent company, subsidiaries, joint ventures, or other companies under
common control with Border Bee (in which case we will require such entities to
honour this Policy); (5) if Border Bee merges with another entity,
is
subject to a corporate reorganization, sells or transfers all or part of its
business, assets or shares (in which case we will require such entity to
assume our obligations under this Policy, or inform you that you are covered by
a new privacy policy).

 

Access to, Verification and Deletion of
Personal Information

If you wish to inquire about and access what Personal Information Border
Bee holds about you, if you wish to verify the accuracy of such Personal
Information, or if you wish to delete any Personal Information held about you
from our databases, please contact us using the information further up in this
Policy. Please note that deletion of your Personal Information may make it
impossible for you to use the Website or the Services, and Border Bee shall not
be liable for any losses or damages (pecuniary or otherwise) resulting from
your request to delete your Personal Information and your resulting inability
to use the Website or Services.

 

Tracking Technology (“Cookies”)

Border Bee uses tracking technology (“cookies”) on the Website and by
using the Website you agree to their use. Cookies are small text files placed
on your hard drive when you visit a website, in order to track use of the site
and to improve the user experience by storing certain data on your computer. The
Website uses “session cookies,” which improve your user experience by storing
certain information from your current visit on your computer.

Risks Associated with the Internet

Despite Border Bee’s best efforts to ensure that third parties will not
access or obtain your Personal Information through your use of the Website,
complete confidentiality and security cannot currently be guaranteed on the
Internet. Communication via the Internet is subject to interception, loss, or
alteration. You acknowledge and agree that Border Bee cannot be held
responsible for damages resulting from the transmission of confidential
information or Personal Information over the Internet and that such
communications are at your own risk.

 

Limitation of Liability

Border Bee, and / or its respective officers, directors, owners,
officials, partners, partnerships, principals, employees, affiliates and other
related entities, servants, agents, representatives, successors and assigns,
will not be held liable for any losses or damages (pecuniary or otherwise) resulting
from the misuse of any information collected by, or stored with, any third
party (whether mentioned in this Policy or not), or any misuse of any
information collected through the Website or Services not in violation of the
Policy.

 

Compliance with Privacy Laws

This Policy and Border Bee’s practices in general are designed to be in
compliance with
Canada’s Personal Information
Protection and Electronic Documents Act
(“PIPEDA”, S.C. 2000, c. 5) and
Quebec’s An Act Respecting the Protection
Of Personal Information in the Private Sector
(R.S.Q. c. P-39.1). If you
